By downloading and using the MemBoostAI application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

We grant you a limited, non-exclusive, non-transferable license to download and use MemBoostAI for your personal, non-commercial use. You may not: • Modify or copy the materials • Use the materials for any commercial purpose • Attempt to reverse engineer any technology • Remove any copyright or proprietary notations • Transfer the application to another person or device

When you create an account, you are responsible for: • Maintaining the confidentiality of your password • All activities that occur under your account • Notifying us of any unauthorized access • Providing accurate and current information • Complying with all applicable laws and regulations

You agree not to: • Harass, threaten, or abuse other users • Transmit viruses or malware • Attempt to gain unauthorized access • Spam or send unsolicited messages • Violate any intellectual property rights • Use the service for illegal purposes • Reverse engineer or attempt to discover source code

You retain ownership of any content you create. However, by using MemBoostAI, you grant us a license to use, reproduce, and display your content solely for providing and improving our service. You are responsible for your content and any consequences of posting it.

The MemBoostAI application, including all content, features, and functionality, is owned by MemBoostAI, its licensors, and other providers of such material. It is protected by copyright and other intellectual property laws. You may not reproduce or distribute any content without permission.

To the maximum extent permitted by law: • We are not liable for any direct, indirect, incidental, or consequential damages • We are not liable for loss of data, revenue, or profits • Our total liability will not exceed the amount you paid us in the past 12 months • Some jurisdictions do not allow limitations, so this may not apply to you

MemBoostAI is provided 'as is' without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or availability of our service. Your use is at your own risk.

You agree to indemnify and hold MemBoostAI harmless from any claims, damages, or costs arising from your use of the application, your content, or violation of these terms.

We may terminate or suspend your account at any time for violating these terms or engaging in prohibited activities. Upon termination, your right to use the service ceases immediately.

We reserve the right to modify these terms at any time. Changes will be effective when posted, and your continued use constitutes acceptance of the modified terms.

These Terms of Service are governed by the laws of the jurisdiction in which MemBoostAI is based, without regard to its conflict of law provisions.

If you are using the MemBoostAI application on an Apple iOS device, the following additional terms apply: • Acknowledgement: You acknowledge that this agreement is concluded between you and Sagicorp Technologies only, and not with Apple, Inc. Sagicorp Technologies, not Apple, is solely responsible for the MemBoostAI application and its content. • Scope of License: The license granted to you for MemBoostAI is limited to a non-transferable license to use the application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service. • Maintenance and Support: Sagicorp Technologies is solely responsible for providing any maintenance and support services with respect to the MemBoostAI application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the application. • Warranty: Sagicorp Technologies is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application. • Product Claims: You acknowledge that Sagicorp Technologies, not Apple, is responsible for addressing any claims of yours or any third party relating to the application or your possession and/or use of the application, including: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. • Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the application or your possession and use of the application infringes that third party’s intellectual property rights, Sagicorp Technologies, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. • Legal Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. • Developer Contact Info: Any questions, complaints, or claims with respect to the MemBoostAI application should be directed to: Sagicorp Technologies Email: memboostai@memboostai.sagicorptech.com • Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the application (e.g., you must not be in violation of your wireless data service agreement when using the application). • Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
